Terms of Service

1. About FlightOwed
FlightOwed ("we", "us", "our") operates an online platform that helps air passengers identify potential compensation claims under EU Regulation (EC) No 261/2004 and connects them with specialised claims enforcement partners.
FlightOwed is a technology and lead-generation platform, not a law firm and not a claims management company. We do not provide legal advice, represent you in legal proceedings, or directly enforce claims against airlines. Where claims enforcement is required, we refer your case to our vetted partner firms who are duly licensed and authorised to provide such services in the relevant jurisdiction.
2. Our Services
2.1 Free Eligibility Check
You may use our online tool to check whether your disrupted flight may qualify for compensation under EC 261/2004. This check is free, fully automated, and creates no obligation. The result is an estimate based on publicly available flight data and the applicable regulation — it is not a legal opinion or guarantee of compensation.
2.2 Partner Referral
If our eligibility check indicates a potential claim, we may offer to connect you with one of our claims enforcement partners. If you choose to proceed:
- We share the flight and contact details you provided with the selected partner.
- The partner will contact you directly to explain their process, fees, and terms.
- Any contractual relationship for the enforcement of your claim is between you and the partner — not between you and FlightOwed.
- You are free to accept or decline the partner's offer with no obligation.
2.3 What We Do Not Do
- We do not accept assignment of your claim.
- We do not act under power of attorney on your behalf.
- We do not negotiate with airlines or represent you in any legal or administrative proceedings.
- We do not handle, hold, or transfer compensation funds.
3. Fees
Using FlightOwed — including the eligibility check and partner referral — is free for passengers. We do not charge you any fees, commissions, or costs.
We may receive a referral fee or commission from our partner firms when a referred claim results in a successful recovery. This does not affect the compensation amount you receive, which is determined solely by the partner's terms with you.
4. Your Obligations
- Provide accurate and complete information about your flight and contact details.
- Not submit fraudulent, misleading, or duplicate claims through our platform.
- Inform us if your circumstances change materially (e.g., you have already received compensation from the airline or engaged another claims service).
5. No Guarantee
Our eligibility check provides an estimate only. We cannot guarantee that any claim will be successful. Airlines may invoke extraordinary circumstances or other defences under EC 261/2004. The decision to pursue a claim and its outcome depend on the partner firm and the applicable legal process.
6. Intellectual Property
All content on this website — including text, graphics, software, data compilations, and design — is our property or licensed to us and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
7. Limitation of Liability
To the fullest extent permitted by law, FlightOwed's total liability to you for any claims arising from or related to our services is limited to €100. We are not liable for:
- The outcome of any claim pursued by a partner firm on your behalf.
- Actions, omissions, fees, or terms of our partner firms.
- Indirect, incidental, special, or consequential damages.
- Loss of data, revenue, or anticipated savings.
8. Right of Withdrawal
As our service is free and no contract for paid services is formed between you and FlightOwed, the 14-day withdrawal right under the EU Consumer Rights Directive (2011/83/EU) does not apply to our services. If you enter into a separate agreement with a partner firm, that firm's cancellation and withdrawal terms apply.
You may request deletion of your data at any time (see our Privacy Policy).
9. Dispute Resolution
We are committed to resolving disputes amicably. If you have a complaint, please contact us at [email protected].
You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
10. Governing Law & Jurisdiction
These terms are governed by the laws of Portugal. Any disputes shall be submitted to the courts of Lisbon, Portugal, without prejudice to mandatory consumer protection provisions of your country of residence.
11. Changes to These Terms
We may update these terms from time to time. The "last updated" date at the top reflects the most recent revision. Material changes will be announced on this page. Continued use of our platform after changes constitutes acceptance.
